Terms of use

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the eNo website and the eNo application (together, or individually, the “Service”) operated by Luna Radiance (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Personal information

eNo will neither collect nor have access to any personal information concerning patients.

We maintain administrative, technical and physical safeguards designed to assist us in protecting our services against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. For example, we use Secure Sockets Layer encryption to protect the exchange of data.

Please note that no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that those measures will always be sufficient or effective.

Cookies

Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of our sites’ features. We use cookies to prevent you from having to type in your username and password at every session.

Service Availability

The Services we offer may be unavailable from time to time, or may be offered on a limited basis. We strive to keep the Services up and running; however, all online services suffer occasional disruptions and outages, and eNo is not liable for any disruption or loss you may suffer as a result.

Payment Terms

All payment is due in Canadian dollars.

To pay the charges for a Service, you will be asked to provide a payment method at the time you sign up for that Service.

Payment for Services is due within thirty days after the date of invoice.

Suspension or cancellation of the Services for non-payment could result in a loss of access to and use of your account and its content.

We may change the price of the Services and notify you by e-mail at least 30 days before the price change. If you do not agree to the price change, you must cancel and stop using the Services before the price change takes effect.

You may cancel a Service at any time, with or without cause. Contact us to cancel a service and request a refund for the unused period.

Software License and Site Access

If you comply with these Terms, we grant you the right to install and use one or more copies of the software per clinic on a worldwide basis for use by only one person at a time as part of your use of the Services. The software or Web site that is part of the Services may include third-party code. Any third-party scripts or code, linked to or referenced from the software or Web site, are licensed to you by the third parties that own such code, not by eNo. Notices, if any, for the third-party code are included for your information only.

The software is licensed, not sold, and eNo reserves all rights to the software not expressly granted by eNo.

All content available through this Site (including, without limitation, text, design, graphics, logos, icons, images, audio clips, downloads, interfaces, code and software, as well as the selection and arrangement thereof) is the exclusive property of and owned by eNo and is protected by copyright, trademark and other applicable Canadian and foreign laws.

Limitations of liability

In no event shall eNo, nor its employees, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Furthermore, the information provided by the service is purely indicative and eNo cannot be held responsible by the clinic or the patient in cases of missed appointments.

Updates to the Services or Software, and Changes to These Terms.

We may change these Terms at any time, and we will tell you when we do. Using the Services after the changes become effective means you agree to the new terms. If you do not agree to the new terms, you must stop using the Services and contact us immediately.

You may also be required to update the software to continue using the Services. Such updates are subject to these Terms unless other terms accompany the updates, in which case, those other terms apply. You may withdraw your consent to future software updates at any time by uninstalling the software.
